Terms of Service

These Terms of Service ("Terms") are an agreement between you and Kranitz Enterprises, Inc. ("RCMarket," "we," "us"), which operates rcmarket.com and its apps. By using RCMarket you agree to these Terms and to our Privacy Policy. If you do not agree, do not use RCMarket.

1. What RCMarket is

RCMarket is a classified marketplace where people list and find radio control models, parts and gear. We provide the listings, search, messaging and tools around them. We are not a party to any sale. We do not own, inspect, hold, ship or guarantee any item, and we do not handle payment between buyers and sellers. Buyers and sellers deal with each other directly and are solely responsible for their transactions.

2. Your account

You must be at least 18 years old, and able to form a binding contract, to create an account.
You sign in with a one-time code sent to your email. Keep access to that email secure; anyone who can read it can sign in as you.
Give accurate information, including a real name to publish ads and a real ZIP code. One person, one account.
You are responsible for everything done through your account.

3. Listing rules

Listing is free. When you post an ad, you promise that:

the item is radio control equipment or directly related to the hobby, and it is yours to sell;
your photos are your own or ones you have the right to use (a maker's product photo is allowed), they show the item you are selling, and your description, condition and price are honest;
if you sell as a business (a shop, a dealer, or selling stock for a living), you say so under Account, so your ads carry the Business badge;
the item is legal to sell and to ship where you offer to ship it, and you will follow carrier and legal rules for items such as lithium batteries and fuel;
you will not list stolen, counterfeit, recalled or prohibited items, weapons or weapon parts, or anything that is not what the ad says.

Ads may not contain phone numbers, email addresses, links to other sites or payment handles, with one exception: a Business account may give each ad a Buy Now link to that item's page on its own store, which RCMarket shows as a Buy Now button. A sale made there is between you and that store; RCMarket does not handle it. Our tools remove them, because buyers reach you through RCMarket messages. Ads run for 60 days and can be renewed. New accounts may have a limit on how many ads they can hold at once.

4. How you treat other members

Do not harass, threaten, deceive or spam anyone. Do not use RCMarket to arrange a scam, to collect other members' contact details for unrelated purposes, or to steer a buyer to an off-site payment that avoids these Terms. Do not ask for payment by gift card, wire transfer or cryptocurrency; links to those are removed from messages. Ratings must reflect a real sale recorded on RCMarket and your honest experience of it. Feedback you bring across from another site must be your own account's.

Do not scrape, copy in bulk, overload, probe or interfere with RCMarket, and do not use automated means to create accounts, post ads or send messages.

5. The assistant, suggested prices and estimates

RCMarket's assistant uses artificial intelligence to read your photos and words and suggest a product, details and a description. It can be wrong. You are responsible for everything in your ad, including anything the assistant filled in; check it before you publish.

The Suggested Selling Price, the deal badges, product specifications and shipping estimates are estimates for convenience only. They are not appraisals, offers, guarantees or shipping labels, and we are not responsible for decisions made on them.

6. Paid boosts

Listing is free. You may pay to feature, bump or highlight an ad. Prices are shown before you pay, and payment is processed by Stripe; we never see or store your card number. A boost starts once payment is confirmed and runs for the period shown. Boost fees are not refundable, except where the law requires it or where we remove an ad because of our own error. A boost does not exempt an ad from these Terms: an ad removed for breaking them loses its boost without a refund.

7. Your content

You keep ownership of the photos, text and other content you post. You give Kranitz Enterprises, Inc. a worldwide, non-exclusive, royalty-free license to host, store, copy, display, resize, adapt and distribute that content in order to run, show and promote RCMarket and your ad (including in share images and search results), for as long as it is on RCMarket and for a reasonable time after for backups and records. Ratings and reviews you leave may stay on the member's profile after your ad closes.

If you believe something on RCMarket infringes your copyright, write to support@rcmarket.com with the material, where it appears, your contact details and a statement that you are the owner or authorized to act for the owner. We will remove material that infringes.

8. Moderation and enforcement

We and our moderators may, at our discretion and without notice, review reported ads and messages, hide or unpublish an ad, remove content, limit features, or suspend or close an account that we believe breaks these Terms, puts members at risk or harms RCMarket. An unpublished ad returns to your drafts. A closed account is signed out everywhere and its ads come down. We are not obligated to monitor RCMarket and we do not endorse any member or ad.

9. Dealing with other members

Meet in a public place for local pickups, inspect before you pay, and use a payment method with buyer protection. Any dispute about an item, payment or shipment is between the buyer and the seller. You release Kranitz Enterprises, Inc., its officers, employees and moderators from claims arising out of your dealings with other members, to the fullest extent the law allows.

10. Disclaimer

RCMarket is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that RCMarket will be uninterrupted, secure or error free, or that any ad, member, estimate or item is accurate, safe or legal.

11. Limitation of liability

To the fullest extent the law allows, Kranitz Enterprises, Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or items, arising out of or related to RCMarket or any transaction between members. Our total liability for any claim related to RCMarket is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred U.S. dollars ($100). Some places do not allow these limits, so they may not apply to you.

12. Indemnity

You will defend and indemnify Kranitz Enterprises, Inc. and its officers, employees and moderators against claims, losses and costs (including reasonable attorneys' fees) arising from your content, your use of RCMarket, your transactions with other members, or your breach of these Terms or the law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute arising out of or related to these Terms or RCMarket will be brought only in the state or federal courts located in Colorado, and you and we consent to their jurisdiction. Before filing a claim, please write to support@rcmarket.com so we can try to resolve it informally.

14. Changes and ending

We may change these Terms. When we do, we will update the effective date above, and for material changes we will give notice on the site or by email. Using RCMarket after a change means you accept it. You may stop using RCMarket at any time and ask us to close your account. We may suspend or end RCMarket or any part of it. Sections 7 through 13 survive the end of your use.

15. The rest

These Terms and the Privacy Policy are the whole agreement between you and us about RCMarket. If a provision is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms; we may transfer them with the business. RCMarket is offered in the United States, in U.S. dollars.
